Broker cooperation guidelines
Farm & Ranch Realty welcomes your interest in our listings and we
look forward to cooperating with you under the following guidelines:
1. Commissions vary by listings and consequently, our office will share in an appropriate manor, usually 50% to each side.
2. There are times when you are only a referring agent/broker
and will be paid a 20% referral fee on the buyer/seller side of the
commission with a closed escrow within one year. Should the referred
buyer come back after one year and close a property there will be no
referral fee paid.
3. All cooperating agents/brokers will be familiar with
agriculture and agricultural properties. We respectfully require this
due to liability concerns of misinformation being given or something
missed that would increase our liability. Should it be our decision to
not cooperate but only give a referral, it will be discussed in greater
detail at that time, and determined at our earliest convenience.
4. The property can only be shown to your client after written
registration of your client on your letterhead designating you as his
sole agent. Before your buyer(s) are registered by you they must be
asked whether:
(a) Your prospect must be informed that he or she is
being registered as your prospect for the specific Farm & Ranch
Realty listing that you are presenting.
(b) He or she must be asked both if he or she has
already been presented the property by someone else and if he or she is
already working with Farm & Ranch Realty. If there is a conflict
between outside brokers, preference will be given to the buyer's choice
of broker and to the broker who is the procuring cause of an offer. If
your prospect is already working with Farm & Ranch Realty, we will
not recognize him or her as your prospect unless you have a written and
fully executed exclusive broker agreement with said prospect.
5. Should you involve third party brokers, you will be
responsible for their compensation from your share of any commission or
referral fee.
6. I have or will supply an information package on each ranch
that will be used in its entirety without modification, without our
permission. Our packages are done thoroughly and lack very little
missing information. If something should be missing we will gladly get
it for you.
7. If another agent/broker or his client contacts my client
directly without my permission during the listing, the cooperating
agent/broker will automatically lose any claim to a portion of any
commission or referral fee.
8 We offer these properties with the right to make correction
of errors, remove property from market due to prior sale or withdraw
from the market for any condition we see necessary.
